City of Carson

Regular Council Meeting

March 12, 2007

Present: Riddle, Pracht, McClain, Hendricks Absent: Damgaard

Mayor Taylor called meeting to order at 7:30 PM.

Pracht made a motion to approve the agenda, seconded by Hendricks – 4 ayes.

Public was present, no comments were made.

Liz Graves was present to present prices for televisions and mounts for the exercise room. Pracht made a motion to approve the purchase of 2 TV's/mounts for the Exercise Room, seconded by McClain. 4 ayes.

Joe Higgins was present to request an extension to abate the nuisance existing at 416 Broadway. Higgins stated the porch would be fixed by the end of this month. Riddle made a motion to give Higgins an extension until the Council Meeting in May and if more time is needed he will need to ask in advanced. Motion failed due to lack of a second motion. McClain made a motion to grant Higgins an extension to abate the nuisance until the end of the March 2007 and he must have the porch and roof fixed, seconded by Hendricks – 3 ayes: McClain, Hendricks, Riddle. 1 nay: Pracht. Motion carried.

John Sehnert, Bernard Cerny, and Robert Ryan of MidAmerican Energy were all present to discuss the renewal of the Gas/Electric Franchises. Sehnert presented packets of information on MidAmerican Energy and a draft ordinance to renew the franchises. Sehnert also provided estimates and information regarding franchise fees. City Clerk was directed to have the City attorney review the draft ordinance as proposed by MidAmerican Energy.

Rick Rohan of Snyder & Associates presented Pay Request No. 11 (Final) for CL Carroll for the Waste Water Treatment Plant Improvement Project. Hendricks made a motion to approve paying $47,484.66 on the pay request and retain the remaining $18,150 until the noncompliance items are completed, seconded by McClain – 4 ayes. Rohan presented the as-builts for the project.

Fire Department Report for February 2007: 2 Fire Mutual Aid Calls (1 to Oakland, 1 to Macedonia), 4 Medical Calls, 2 Mutual Aid Personal Injury Calls to Oakland.

Pracht made a motion to approve Resolution 2007-11 (No Camping in Park During June 8 th -10 th for Civil War Re-Enactment) , seconded by Riddle – 4 ayes. City Clerk will notify the public in advanced.

Council reviewed a letter dated February 19, 2007 from Carson Community Rodeo regarding requests with regards to the Rodeo Drive Storm Drainage Easement and Improvements. Council agreed the Rodeo's requests were fine. The Clerk stated the project should be contingent on grant approval/funding availability. Hendricks made a motion to apply to the CITIES Grant program for Rodeo Drive Storm Sewer Improvements Project, seconded by Riddle – 4 ayes.

Hendricks made a motion to approve Ordinance 182 (Meter Installation Fee-3 rd & Final Reading), seconded by McClain – 4 ayes.

Hendricks made a motion to approve Ordinance 183 (Establish a Sewer Rate for Sewer Customers with Private Well Water-approve 1 st Reading as Final--2 nd & 3 rd Readings were Waived), seconded by Pracht – 3 ayes: Hendricks, Pracht, McClain. 1 nay: Riddle. Motion Carried.

Hendricks made a motion to approve Ordinance 184 (Renew Cable Television Franchise for 25 years with Interstate Cablevision-approved 1 st Reading as Final—2 nd & 3 rd Readings were Waived), seconded by Pracht – 4 ayes.

Hendricks made a motion to approve Pay Request for Housing Rehab Grant Program for Walnut Creek, seconded by Pracht – 4 ayes.

Hendricks made a motion to set the date for Public Hearing Regarding 2006/2007 Budget Amendment to be held on May 7, 2007, seconded by McClain – 4 ayes.

Council reviewed a letter from Norma Buckingham regarding the Country Stores equipment repair expenses incurred. Riddle made a motion to table further consideration of the Country Store's repair bills, seconded by Hendricks – 4 ayes.

Maintenance Reports were given regarding snow emergency ordinance, Dodge truck repairs, Mertes Welding is working on ways to improve the High Street signage, new backhoe specs and bid, well levels and the sale of water to local farmers. It was noted that water will only be sold this year to the 4 farming customers who purchased water for agricultural use in 2006 (including L. Plagman) due to low well levels. Riddle made a motion to go out for bids for a new backhoe, seconded by Pracht – 4 ayes. A list of backhoe specs will be on file for review at City Hall.

Hendricks made a motion to approve the Consent Agenda, seconded by Pracht – 4 ayes. The consent agenda consisted of February 12 & March 5, 2007 Minutes, March Bills, Utility Report, Building Permit Report, Overtime Report, Municipal Infraction Report, Sheriff Report, Community Center Reports, and the Clerk and Treasurer Reports.

Riddle presented a photo of the nighttime firing of a cannon at the 2006 Carson Civil War Reenactment. The photo was given to the City from the Civil War Re-enactors: Western Iowa Brigade. The photo will be on display at the Community Center.

Hendricks made a motion to adjourn at 9:10 PM, seconded by McClain – 4 ayes.
